Terms of Service

These Terms of Service ("Agreement", "TOS", "Terms and Conditions") apply to your use of the v4Guard service ("v4Guard", "the service") provided by Ismael Muñoz Hernández ("we", "us"). By using the service, you agree to be bound by this Agreement. If you do not agree to be bound by this Agreement, do not use the service.

Licensing

A v4Guard license is granted to a single company and cannot be transferred or resold to other companies without prior written consent from us. The v4Guard license is granted for the purpose of using the service and any unauthorized use is a breach of this Agreement.

A license is provided for use by companies that meet v4Guard's internal requirements. v4Guard reserves the right to refuse service to any company at its sole discretion.

Transparency

The connector used with the service is open-source for transparency purposes only. The official connector must be used, and any modification of the connector (without written consent) that changes the way data is being sent and handled is strictly prohibited. Any violation of this requirement may result in termination of the contract and suspension of the service.

Obligations and Restrictions

The following obligations and restrictions apply to the use of the service:

  1. You are not allowed to use v4Guard for commercial purposes or on behalf of a third party. You cannot use the service in any manner that violates any applicable local, national, or international law.
  2. v4Guard does not allow or provide service to people that may be or was related to communities involved in griefing, cheating/bypassing (including anti-cheats, and the cheaters themselves), botting, or exploiting activities. This also applies for team members.
  3. Using the service for test-server or bypassing purposes is strictly prohibited without prior knowledge and written consent from us.
  4. You are not allowed to give third parties access to the service without prior consent from us, this includes sharing limited access information provided by the service, or giving direct or indirect access to the service, such as sharing your account, adding unauthorized/unrelated users, or sharing your license key.
  5. You agree not to create an application, product, or service that is competitive in any way with v4Guard while using the service, without prior notice and written consent granted.
  6. You agree not to use the service in any way that may damage, disable, overburden, or impair the service.
  7. You are not allowed, furthermore, you agree not to, or attempt to, modify, reverse engineer, spoof or inject data on any part of the service that it is not explicitly created for that purpose, which includes allowing others to do so.
  8. v4Guard is not a developer's API, hence, you are not allowed, and you'll refrain from attempting to create third-party applications/connectors that attempts to interact with the service in a way that is not explicitly allowed by us. We're open source for transparency purposes only.
  9. v4Guard reserves the right of admission, and we may reject or cancel any order/license for the Service at any time if we believe that you are not eligible to use the service.
  10. We may require you to provide additional information to verify your identity, and we may suspend your account until we receive the required information. This refers to valid proof of identity, and the use of Stripe Identity technology in order to verify user's identity in order to prevent fraudulent usage, comply with legal obligations, prevent abuse of the service, or enforce this Agreement.
  11. We reserve the right to change the terms of this Agreement at any time, without prior notice. We may notify you of any changes to the terms of this Agreement by email or Discord, or just by making them publicly available on this website. Your continued use of the service after such changes have been posted constitutes your acceptance of the new terms.
  12. We reserve the right to change the pricing of our services at any time, without prior notice. Even though we will try to notify you of any changes to the pricing of our services with a reasonable amount of time, you accept that we may not be able to do so in some cases, and it's up to you to check the pricing of our services before making or renewing your subscription.
  13. We may enforce a fair-use policy to limit the resource consumption of a customer through our SaaS connector or infrastructure when using our services. We may restrict the number of instances accessible to a user if we deem that the quantity of servers they operate is excessive, unstable or abusive.
  14. We may provide technical support to its customers on normal basis, but this support is not guaranteed and may be limited to the availability of our team, complexity of the issue, or the customer's plan. We may also limit or refuse support to customers that we believe are engaged in abusive activity, are against our terms of service, or are not eligible for support. We reserve the right to not disclose the reason for the refusal of support.
  15. We may cooperate with law enforcement agencies, government authorities, or other third parties to enforce the law, protect our rights, or protect the rights of others. We may disclose any information about you to these parties if we believe that it is necessary to do so in order to comply with the law, enforce this Agreement, or protect the rights, property, or safety of us, our customers, or others.
  16. You are not allowed to use the service in a way that harasses, abuses, threatens, defames, doxxes, or otherwise violates the legal rights of others. Using the service to get personal inforamtion about others in order to DDoS, or any other malicious activity other than the intended use of the service is strictly prohibited.
  17. We may modify or update the software at any time, without prior notice in order to improve the service, performance, security or add new features. We reserve the right to do so and we do not guarantee compatibility with previous versions of the software, or with the server environment of the customer. The customer is responsible for ensuring compatibility with their running environment.
  18. The customer acknowledges that our detection algorithms are not infallible and there is no guarantee that all anonymization services will be detected. The customer acknowledges that the service is not 100% accurate and that there may be false positives or negatives. v4Guard shall not be held responsible for any damages or losses caused by the use of the service.
  19. We reserve the right to request proof of residence in a specific country in case a credit card issued in that country was used. This measure is intended to prevent fraudulent or illegal activities such as 'carding', especially by users from high-risk regions. Failure to provide proof of residence may result in the suspension or termination of the user's license without prior notice.
  20. We reserve the right to restrict, access to our services from IP addresses originated in sanctioned countries, or countries with a high risk of fraud. We may also restrict access to our services from IP addresses that are known to be associated with fraudulent activities, or that are known to be used by malicious actors, such as spammers, malware C2-servers, or DDoS-for-hire services. This will render the service unusable from the restricted IP addresses.

Intellectual Property and Ownership

We will at all times retain ownership of the service as originally used by you and all subsequent uses of the service by you. The service (and the copyrights, and other intellectual property rights of any nature in the service, including any modifications made to them) are and shall remain our property. This includes any modifications to the connector, and any other software or code used by the service.

Termination

This Agreement is effective from the date when you start using the service, and will continue until the plan ends and you stop using the service.

If you fail to comply with any term of this Agreement, it will result in immediate termination and suspension of the license, and you agree to discontinue all access and use of the service, even if the paid period has not been completed.

Refund Policy

v4Guard does not accept refunds. Due to the nature of the services we provide, once the products or services are provided, they cannot be returned or refunded. You waive any right to a refund once the service has been provided to you, and you agree that you will not chargeback any payment made to us.

Any breach of the Agreement will not entitle you to a refund of the service fee, and will result in an immediate and permanent suspension of the service.

If you are not satisfied with the service, you may cancel your subscription at any time, but no refunds will be issued.

Fraudulent Activity

By agreeing to this Agreement, you acknowledge that v4Guard reserves the right to block certain connections deemed malicious or associated with fraudulent activities against the v4Guard network. These blocked connections cannot be whitelisted.

We may block connections that pose a threat to the service or have engaged in fraudulent activities against the v4Guard network, including our services or those of our customers. Such cases are rare and cannot be appealed or whitelisted. While we will generally provide a reason or evidence for the block, we reserve the right to withhold such information at our discretion.

If a connection of a customer’s service is blocked, the customer or the connection author may contact us for further information. We may or may not provide a reason or resolution, such as reviewing the situation or imposing a temporary block.

Applicable Law

This Agreement and any disputes arising out of or in connection with this Agreement shall be governed by and construed in accordance with the laws of Spain.
